2.The respondent herein has filed a suit for partition in O.S.No.2 of 2007 before the III Additional Judge, Gobichettipalayam. In the aforesaid suit, written statement has been filed by the petitioners claiming that the item Nos.1 to 10 of the suit properties are not come under the joint family properties and the respondent is claiming right in respect of item No.9 of the suit property against the second petitioner. In the aforesaid suit, an interlocutory application in I.A.No.1469 of 2016 has been filed by the respondent/plaintiff under Order 1 Rule 10 of the Code of Civil Procedure to implead the second petitioner herein/ proposed party as second defendant in the suit on the ground that the 9th item of the suit property stands jointly in the name of the respondent along with the second petitioner herein and also claiming right over the suit property. The revision petitioner herein filed a counter opposing the said application. However, the trial Court allowed the I.A.No.1469 of 2016 in O.S.No.2 of 2007 on 12.04.2017 and thereby, the second petitioner was impleaded as second defendant in the above suit.
