Writ Petitions are filed under Article 226 of the Constitution of India, praying for the issuance of Writs of Mandamus, directing the respondents to pay the Selection Grade and Special Grade to the petitioners in the respective posts Junior Assistant, Record Clerk, Junior Assistant, and Storekeeper on completion of 10 years and 20 years of service respectively, as per the Government Order letter No.63305/Pay Cell/2010-1, dated 8.11.2010 and Letter No.44826/Pay Cell/20111, dated 30.8.2011, awarding the same to the Ministerial Service post in the Private Aided School.

The relief sought for in these writ petitions is for a direction to direct the respondents to pay the Selection Grade and Special Grade to the petitioners in the respective posts, on completion of 10 years and 20 years of service respectively, as per the Government letter dated 8.11.2010 and 30.8.2011, as the same were awarded to the Ministerial Service, passed in the Private Aided School.

The learned Senior Counsel, appearing for the writ petitioners, made a submission that the writ petitioners are Non-Teaching Staff and they are eligible for Selection Grade on completion of 10 years of service and Special Grade on completion of 20 years of service respectively. The learned Senior Counsel, appearing for the writ petitioners, further made a submission that the Government issued revised instructions in letter No.2532/C1/2014-2, dated 16.3.2015, in relation to the grant of Selection Grade and Special Grade to the Non-Teaching Staff.

Under these circumstances, the revised instructions issued by the Government are to be followed for the purpose of grant of Selection Grade and Special Grade to the writ petitioners, based on their period of length of service and other conditions stipulated.

Thus, without going into the merits of the matter, the first respondent is directed to consider the joint representation submitted by the writ petitioners on 27.3.2014 and pass orders on merits and in accordance with law, taking note of the revised instructions issued by the Government in Letter No.2532/C1/2014-2 dated 16.3.2015, within a period of 12 weeks from the date of receipt of a copy of this order.

Accordingly, the writ petitions stand disposed of. However, there shall be no order as to costs. Consequently, connected miscellaneous petitions are closed.
