Writ Petition filed under Article 226 of the Constitution of India, to issue a writ of declaration declaring that the action of respondent in Letter No.ES3/2232/97 dated 16/04/2002 invoking the Bank Guarantee B.G.No.2/97 dated 06/05/97 for Rs.2,90,000/issued by the Indian Bank, Arunachalam Road, Saligramam Branch, Chennai, as illegal and invalid.
Learned counsel for the petitioners submitted that the prayer sought in this petition has become infructuous and he has made an endorsement to that effect.
In view of the above submission and endorsement made by the learned counsel for the petitioners, this petition is dismissed as having become infructuous. No costs. Consequently, connected miscellaneous petition is closed.
