2. The learned counsel for the petitioner has further submitted that without prejudice to the right, the petitioner has deposited a sum of Rs.3 lakhs to the respondent-municipality.
Petition is dismissed as having become infructuous. Liberty is granted to the petitioner, to approach the appropriate forum, for the refund of Rs.3 lakhs deposited to the municipality, if so advised . No costs. M.P. 1 of 2013 is Closed. Sd/Assistant Registrar
