Petition filed under Article 226 of The Constitution of India praying to issue a writ of mandamus directing the first respondent to issue the Sale Deed in favour of petitioner for the property measuring 1500 sq.ft. in plot No.2164 comprised in survey No.713/1B1 situated at Paruthipattu Village, Sriperambuthur Taluk, Kancheepuram District in compliance with their own letter dated 21.07.1999. The learned counsel appearing for the petitioner sought permission of this Court to withdraw the Writ Petition with liberty to file an Execution Petition to execute the decree and judgment passed by VI Assistant Judge, city Civil Court, Chennai in O.S.No.5972 of 2001 and he has also made an endorsement to that effect.
2.In view of the same, the Writ Petition stands dismissed as withdrawn. It is open to the petitioner to file an Execution Petition for executing the decree and judgment passed in O.S.No.5975 of 2001 on the file of VI Assistant Judge, City Civil Court, Chennai. No costs.
