DECREE: This Second Appeal is coming on for hearing on 23^rd January 2017 and upon perusing the grounds of Appeal, the Judgments and Decrees of the Lower Appellate Court and the Court of first instance and the material papers in the suit and upon hearing the arguments of Mr.V.Meenakshi Sundaram, Advocate for Mr.D.Nallathambi, Advocate for the Appellant, and Mr.S.S.Thesigan, Advocate for the 1^st respondent and Mr.M.S.Suresh Kumar, Advocate https://hcservices.ecourts.gov.in/hcservices/ for the respondents 2 and 4 and the respondents 3,5 to 7 are exparte before the courts below and the 8^th respondent is minor and this Court doth order and decree as follows:

that the Judgment and Decree passed by the Additional Subordinate Judge, Tenkasi in A.S.No.6 of 2010, dated 30.11.2010 confirming the Judgment and Decree made in O.S.No. 47 of 2005 dated 15.12.2009 on the file of the District Munsif Court, Senkottai be and hereby is confirmed and this Second Appeal is dismissed.

that the appellant/Plaintiff shall file a final decree application in respect of his undivided 1/8 share in the suit property within a period of two months from the date of receipt of a copy of the Judgment.
