Upon perusing the Grounds of Appeal, the Judgement and Decrees of the Lower Applellate Court, and the court of First instance and the material papers in the suit and upon hearing the arguments of M/S.V.S.DHANA ARAVINDHA BALAJI, Advocate for the Appellants and of Mr.D.Gandhiraj, Advocate for the Respondent and this court while dismissing this appeal doth order and decree as follows:-

(i)That the Judgement and Decree made in A.S.No.31 of 2010 dated 21.02.2011 on the file of the subordinate Judge, Kovilpatty confirming the Judgement and decree made in O.S.No.3 of 2007 dated 07.01.2010 on the file of the district Munsif-cum-Judicial Magistrate, Vilathikulam be and hereby are Confirmed and the second Appeal is dismissed.
