Prayer : This Habeas Corpus Petition is filed under Article 226 of the Constitution of India, praying for the issue of a Writ of Habeas Corpus, directing the 1^st and 2^nd respondents to produce the body of the detenue namely Manju aged about 23 years before this Court and set her at liberty.

The petitioner is the husband of the detenue by name Manju. Last occasion the detenue was produced before this Court and the detenue was set at liberty and once again the matter is posted https://hcservices.ecourts.gov.in/hcservices/ today to reiterate her desire to join the petitioner.

2.Today, the learned counsel for the petitioner has submitted that the petitioner has aggreed to withdraw his complaint pending in Crime No.214/17 on the file of Colachal Police Station. A memo of compromise has also been signed by the petitioner and the third respondent, who is the father of the detenue. Though clause I of the memo of compromise shows that the detenue has handed over all the jeweleries, it is submitted by both the counsels that there is no objection on behalf of the third respondent for the detenue to keep the jeweleries. Parties have also aggreed to obey the clauses 2 to 4 of the compromise memo.

3.In such view of the matter, this Court is of the view, in as much as the matter stands settled amicably, the complaint pending in Crime No.214/2017, as aggreed upon by the petitioner, has to be closed, which accordingly, stands quashed. The memo of compromise filed on behalf of the petitioner and third respondent, which was duly attested by the respective counsels shall form part of this order.
