Plaint filed under Order VII Rule 1 of C.P.C. read with Order IV Rule 1 of O.S.Rules praying to pass a judgment and decree:-

a) directing the Defendant to pay a sum of Rs.1,14,64,358/-
(Rupees One Crore fourteen Lakhs Sixty Four Thousand Three Hundred and Fifty Eight only) as on 30.11.2009 with contracted interest at the rate of 1.5% per month from the date of Plaint till the date of payment in full
to the plaintiff and pass such further order or orders as this Hon'ble Court
may deem fit and proper in the circumstances of the case.

J U D G M E N T
The learned counsel for the plaintiff, by his letter dated 27.11.2017
stated that the plaintiff has instructed him to withdraw the suit.
2.Mr.M.S.Thanvir, learned representing counsel for Mr.Anand Abdul

and Vinodh Associates, counsel made an endorsement to that effect. It is seen from the records that the evidence in the suit has not been commenced. Hence, the suit is dismissed as withdrawn with settled out of
Court. There will be an order for refund of the entire Court fee under
Section 69 of the Tamil Nadu Court Fees and Suit Valuation Act, 1955.
