PRAYER: Criminal Appeal filed under Section 14A(2) of SC/ST (POA) Act, 1989 as amended by Act 1/2016 to call for the entire records relating to the order dated 09.03.2017, made in Cr.M.P.No.436 of 2017 on the file of the learned II Additional Sessions Judge, Tirunelveli and to set aside the same as arbitrary insofar as the petitioner is concerned and consequently to release the petitioner on bail in connection with the FIR in Crime No.162 of 2015 on the file of the respondent Police.

The appellant/5^th accused, who was arrested and remanded to judicial custody on 12.07.2015, for the offences punishable under Sections 147, 148, 449, 302 r/w Section 3(2)(v) of SC/ST (POA) Act, filed bail petition before the learned II Additional Sessions Court, Tirunelveli in Cr.M.P.No.436 of 2017, which was dismissed on 09.03.2017. Challenging the same, the appellant has filed this appeal before this Court.

Heard Mr.S.Angappan, learned counsel appearing for the appellant and Mr.R.Ramachandran, learned Additional Public Prosecutor appearing for the respondent.

This Court, after going through the merits, has dismissed the appellant's bail petition in Crl.A(MD)No.131 of 2017 https://hcservices.ecourts.gov.in/hcservices/ on 27.04.2017. Further this Court sees no change in circumstances to entertain this second appeal.

Accordingly, this appeal for bail is dismissed.
