The writ petition has been filed under Article 226 of the Constitution of India, seeking an order in the nature of writ of mandamus, directing the respondents to issue family card to the petitioner, viz., S.Kalaiganh, s/o, Solai, Karadichithur village and post, Chinnasalem Taluk, Villupuram District, as per the applications submitted on 15.10.2013 in Petitioner's Application No.143/2013 and based on the petitioner's representation, dated 02.03.2016.

The petitioner is residing in Karadichithur village and post, Chinnasalem Taluk, Villupuram District and he made an application to the second respondent on 15.10.2013 in Application No.143/2013, enclosing the certificate for removing

the name of the petitioner and his wife from their original family card. According to the petitioner, the respondents did not pass any order in his application till date and they were keeping it pending for more than five years, without passing any order. While so, the petitioner sent a representation to the respondents on 02.03.2016 and till date, no order has been passed on the representation of the petitioner. Hence, the petitioner has come forward with the present writ petition, seeking for the relief as stated supra.

Heard the learned counsel appearing for the petitioner as well as the learned Special Government Pleader appearing for the respondents.

Considering the facts and circumstances and after hearing the submissions of both sides, I am of the opinion it would be appropriate to direct the respondents to dispose the representation of the petitioner. Accordingly, the respondents are directed to consider the representation of the petitioner, dated 02.03.2016, within a period of Eight weeks from the date of receipt of a copy of this order, after affording reasonable opportunity of personal hearing to the petitioner. It is also made clear that this Court has not expressed any opinion with regard to the merits of the claim of the petitioner and it is open to the respondents to decide the issue purely on merits and in accordance with law.
