PRAYER : This Civil Suit filed under Order IV Rule 1 O.S. Rules and Order VII Rule 1 CPC, praying for the following reliefs:

(a) to declare the Judgment and Decree dated 27.07.2000 passed in C.S.No. 180 of 1998 as null and void;

(b) to consequentially declare the sale deed bearing Doc. No. 3209 of 2003 dated 19.11.2003 executed in favour of the First defendant and registered in the

office of the Sub-Registrar, Thiruporur as null and void;

© to declare the sale deed bearing Doc. No. 2429 of 2009 dated 16.03.2009 executed in favour of the third defendant by the first defendant and registered in the office of the Sub-Registrar, Thiruporur as null and void; and

JUDGMENT

As directed, the name of the plaintiff has been printed in the cause list. The

matter is posted under the caption 'for dismissal'.

2. It had already been noted that there has been no representation on

behalf of the plaintiff and further, the learned counsel appearing for the plaintiff stated that he had given change of vakalat.

3. It is clear that the plaintiff has abandoned the case. Hence, the suit

is dismissed for non-prosecution with the cost of the second defendant.
