The husband of the petitioner joined as a Avenue Coolie in the fifth respondent Town Panchayat in the year 1959. He was a contingent employee. He has rendered his services without any break. In the circumstances, he was regularised in service, by the fifth respondent Town Panchayat on 12.02.1988 with effect from 15.05.1981, which is evident from the entry in the service register produced before this Court. However, the time scale has been fixed as per G.O.Ms.No.878, Rural Development Department, dated 15.05.1981, on completion of ten years of service as on 15.05.1981.

Learned Additional Government Pleader submitted that the aforesaid regularisation of the fifth respondent should have been done after getting approval from the concerned District Collector. Since no such approval was obtained, the local fund audit had raised objection with regard to the terminal benefits such as, DCRG, Family pension, Commutation of Pension and Leave Encashment benefits etc., being given to the husband of the petitioner, pursuant to regularisation. However, on the death of the husband of the petitioner i.e., on 15.06.1996, he has been paid pension and the petitioner is also paid family pension. The pension and family pension are paid for the eligible service of the husband of the petitioner i.e., for 25 years three months and 15 days.

The issue now is as to non payment of DCRG, Commutation of pension, Leave Encashment etc.. These benefits are not given since the local fund audit had raised objection on the ground that the husband of the petitioner was not regularised in the manner known to law and the regularisation was without the approval of the District Collector.

In these circumstances, the petitioner has approached this Court seeking for a direction to pay appropriate family pension and DCRG and other benefits. The petitioner has enclosed a proceedings dated 13.03.2015, in which it is stated that the terminal benefits are not settled due to non availability of records. Hence, this Court passed the following order on 01.07.2015:

"The husband of the petitioner died on 15.06.1996. The grievance of the petitioner is that the terminal benefits have not been so far settled. The fifth respondent by proceedings dated 13.03.2015, stated that as they are searching for records, they could not settle the terminal benefits to the petitioner. Hence, this Court directs the fifth respondent to send appropriate proposal to the second respondent and to produce the report before this Court. However, till date no such proposal was sent.

Hence, the fifth respondent is directed to be present before this Court on 13.07.2015, along with necessary records. Post the matter on 13.07.2015."

Today, the fifth respondent, Commissioner of Town Panchayat is present with all the files. He has produced the proceedings of the eighth respondent dated 04.06.2015, addressed to the Principal Secretary to Government, Municipal Administration and Water Supply Department, Chennai 600 009. In the facts and circumstances of the case, I am of the view that the Principal Secretary to Government, Municipal Administration and Water Supply Department and the Director of Municipal Administration, Chepauk, Chennai are necessary parties and hence, suo motu they are impleaded as seventh and eighth respondents in this writ petition. Unless the seventh respondent passes an order approving the regularisation of the services of the petitioner's husband, the local fund audit could not authorise the https://hcservices.ecourts.gov.in/hcservices/ sanction of DCRG, Commutation of Pension, family pension etc.

Hence, a direction is issued to the seventh respondent namely, the Principal Secretary to Government, Municipal and Administration and Water Supply Department, to pass an appropriate order on the proposal sent by the Director of Municipal Administration, Chennai, dated 04.06.2015 relating to the regularisation of the husband of the petitioner, within a period of twelve weeks from today and based on the same, the local fund audit, the second respondent, i.e., the Director of local fund audit Department is directed to issue appropriate orders authorising DCRG, Commutation of Pension, Family Pension etc., within a period of four weeks thereafter.
