course of which, an attempt was made by two remand prisoners to assault one Ashok Kumar, who was the newly recruited Grade II Warder, at the instigation of one NSA detenue Madani. Charge memo was issued against the petitioner for the same incident on 29.9.1998 by the third respondent/Deputy Inspector General of Prison, Coimbatore for his lack of supervision stating that he did not take steps to avoid the incident and to control the same by taking precautionary steps and the same is in violation of Rule 275 of Prison Manual, Part II and Rules 20(1) and 20(2) of Government Servant Conduct Rules and punishable under Section 54(1) of Prison Act 1894. The petitioner was on receipt of the charge memo, sought for certain documents to submit his explanation and the same was postponed to later date and the document sought for by him was not furnished immediately and the petitioner was compelled to submit his explanation without relevant documents to be supplied to him. Not satisfying with his explanation, departmental enquiry was held and the enquiry report was submitted, holding the charges proved against the petitioner. Thereafter, the petitioner was served with show cause notice along with enquiry officers' report for the proposed punishment of stoppage of pay. Immediately the petitioner submitted his explanation. However, the third respondent, not satisfying with the explanation offered by the petitioner, imposed punishment of stoppage of pay at the bottom stage for three years with cumulative effect. Aggrieved against the same, the petitioner preferred an appeal before the second respondent, who confirmed the same. His further appeal before the first respondent was also rejected by a non speaking order, which compelled the petitioner to approach this court by way of the present writ petition for the relief as stated supra.
