This petition came to be numbered by transfer of O.A.No.1034 of 2004 from the file of the Tamil Nadu Administrative Tribunal, praying for a Writ of Certiorari, to call for the records of the respondent in connection with the impugned order in RC.No.82/PR3/441/03 PR 03/B1/03 dated 30.06.2003 and quash the same.

The petitioner was issued with a charge memo under Rule 3(b) of the TNPSS (D & A) Rules, 1955 making the following allegations:-
"Irresponsible behavior and neglect of duty in having failed to ascertain whether the 6 sets of preventive detention booklets due to Government were handed over in time even though he resumed duty on 23.11.2001 from Medical Leave, as the detention order against detenue Banu was approved by the Collector, Tiruvannamalai in D.O.No.87/2001 on 21.11.2001 and due to the belated submission much hardship has been caused in the important item of sensitive matter and also the detention order now cannot be approved by the Government"
Irresponsible behavior and neglect of duty in having failed to submit 6 sets of preventive detention booklets due to Government in time on 04.02.2002 though the detention order against detenue Aranji W/o Munusamy, Eraiyur Village was approved by the
Collector, Thiruvannamalai in D.O.22/02 on 03.02.02 which was subsequently handed over at Secretariat on 12.02.02 only after repeated phone calls from Collectorate."
