Prayer:- The suit is filed under Order VII Rule 1 C.P.C. r/w order IV rule 1 of O.S.rules
a) to declare that the defendant is not entitled to raise any claim on the basis of the plaintiff's letter dated 6th August 2008;
b) to direct the defendant to repay to the plaintiff a sum of Rs.8,20,000/- (Rupees Eight Lakhs Twenty Thousand Only) being the sum of Rs.5,00,000/- and interest thereon Rs.3,20,000/- at the rate of 24% p.a. computed from 6th August 2008 till the date of plaint and further interest at the rate of 24% p.a. on the sum of Rs.5,00,000/- from the date of plaint until the date of realisation;
c) to grant an order of permanent injunction restraining the defendant from raising any illegal claim or initiating any proceeding against the plaintiff company on the basis of the letter dated 6th August 2008

Both the learned counsel on record are present and filed a memo dated 08.12.2016, stating that the parties have settled the issue out of Court and filed compromise agreement dated 24.11.2016 and prays for withdrawal of the suit. The said compromise agreement and the memo are recorded. Hence, the suit is dismissed as withdrawn. The compromise agreement and the memo shall form part of the decree. Consequently, connected original application is closed. No costs.
