ORDER : The Court Made the following order :-

There are totally four accused in this case. The petitioner, who is arrayed as A4 in Crime No.456 of 2014, on the file of the respondent Police, apprehending arrest at the hands of the respondent Police for the alleged commission of offences, which is said to have been committed on 21.08.2014, punishable under Sections 4(1)(a), 4(1)(aaa), 4(1-A) and 24 TNP Act read with 486 and 270 I.P.C., seeks anticipatory bail.

2. The case of the prosecution is that the petitioner is the licence holder of TASMAC Shop bearing No.11940, situated at Puttur and A1 and A2 paid monthly rent to the petitioner/A4. A1 and A2 kept 2226 illicit liquor bottles illegally and sold the same as original liquor in the Bar.

3. The learned counsel appearing for the petitioner would submit that the petitioner is an innocent and he has nothing to do with the alleged commission of offence.

4. Learned Government Advocate (Crl. Side) would submit that the respondent Police arrested A1 and A2 on 21.08.2014 and remanded to judicial custody and the investigation is pending. Further, he would submit that the petitioner is not having any bad antecedent.

5. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl. Side) appearing for the State and also perused the entire materials available on record.

6. Considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on anticipatory bail. Accordingly, the petitioner is ordered to be released on bail in the event of his arrest or on his appearance before the learned Judicial Magistrate, Rajapalayam, and on executing a personal bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police daily at 10.00 a.m., and 05.00 p.m., until further orders. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously.

7. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready failing which, the petition for anticipatory bail would stand dismissed.
