PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C.

ORDER : The Court Made the following order :-

The petitioner, who is arrayed as accused, apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 147, 148, 341 and 302 of IPC., in Crime No.336 of 2014, on the file of the respondent police and hence, seeks anticipatory bail.

2.The case of the prosecution is that due to previous enmity between the family of the deceased and the first accused viz., Vijayalingam over selling of the Karuvelam trees, the accused assaulted the deceased and caused his death.

3.The learned counsel for the petitioner submitted that there are 8 named accused in the FIR and the petitioner was implicated only on the confession of the second accused. It is further submitted that even as per the confession, the accused had travelled in the auto belonging to the petitioner. The learned counsel further submitted that there is no, other allegation against the petitioner.

4.The learned Government Advocate (Crl.side) submitted that as per the confession, the accused before committing the offence travelled in the share auto belonging to the petitioner bearing Registration No.TN64 T 1796. The main accused have been secured and they are in judicial custody.

5.Considering the nature of allegations made against the petitioner, this Court is inclined to grant interim anticipatory bail to the petitioner, with certain conditions.

6.Accordingly, the petitioner is ordered to be released on bail in https://hcservices.ecourts.gov.in/hcservices/ the event of arrest or on his appearance before the Judicial Magistrate No.IV, Madurai and on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the

satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police daily at 10.00 a.m until further orders. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. Scrupulously.

7.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy is made ready failing which, the petition for anticipatory bail stands dismissed.
