ORDER : The Court Made the following order :-

The petitioners are A1, A4 to A6 and they were arrested and remanded to judicial custody on 26.07.2014, for the alleged offences punishable under Sections 147, 148, 120(b), 294(b), 324 and 302 of IPC., in Crime No.135 of 2014, on the file of the respondent and hence, seeks bail

2.The case of the prosecution is that due to previous enmity the accused have attacked the deceased with lethal weapons and caused his death on 25.07.2014.

3.The learned counsel appearing for the petitioners submitted that the deceased was an accused in 47 criminal cases, including four murder cases and he was having life threat in the locality. It is further submitted that as per the First Information Report, only four accused are said to have attacked, but now the respondent police have filed a case against seven accused. It is further submitted that investigation is over and the accused may be released on bail.

The learned Government Advocate (Criminal side) for the respondent submitted that the deceased was acting as thug under the first https://hcservices.ecourts.gov.in/hcservices/ accused and subsequently, he demanded huge amount from A1. Hence, the first accused has conspired with other accused, committed the murder. It is further submitted that the major part of the investigation is over.

5.Considering the facts and circumstances of the case and also considering the fact that the petitioners have been incarceration, since 26.07.2014, this Court is inclined to enlarge the petitioners on bail.

6.Accordingly, the petitioners are ordered to be released on bail, on their executing a personal bond each for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Pudukkottai and on further condition that the petitioners shall appear before the respondent police daily twice i.e., at 10.00 a.m., and 5.00 p.m., until further orders.
