PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C.

ORDER : The Court Made the following order :-

The petitioner, who is arrayed as sole accused, apprehends arrest at the hands of the respondent police for the alleged offence under Section 365 of IPC., in Crime No.755 of 2014, on the file of the respondent police and hence, seeks anticipatory bail.

The case of the prosecution is that the accused had abducted the daughter of the defacto complainant on 27.08.2014.

The learned counsel for the petitioner submitted that the petitioner and the daughter of the defacto complainant fell in love with each other and they got married on 27.08.2014.

The learned counsel for the intervener submitted that the alleged victim was produced before the Division Bench of this Court in H.C.P(MD) No.1048 of 2014 and after obtaining the statement, she has been sent along with her mother.

The learned Government Advocate (crl.side) for the respondent submitted that the victim is secured.

Considering the nature of the allegations made against the petitioner, I am inclined to enlarge the petitioner on anticipatory bail with certain conditions.

7.Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate No.II, Nagercoil and on executing a bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties each for a like https://hcservices.ecourts.gov.in/hcservices/ sum to the satisfaction of the Court concerned and on further condition that the petitioner shall appear before the respondent police daily at 10.00 a.m., for a period of two weeks and thereafter, as and when

required, for interrogation. The petitioner shall comply with the condition stipulated under Section 438 of Cr.P.C. Scrupulously.

8.The petitioner shall appear before the concerned Court within a period of 15 days from the date on which the order copy is made ready failing which, the petition for anticipatory bail stands dismissed.
