PETITION FOR BAIL Under Sec. 439 Cr.P.C. ORDER : The Court Made the following order :-

The petitioners are A5 and A8 and they were arrested and remanded to judicial custody on 19.06.2014, for the alleged offences punishable under sections 147, 148, 341, 294(B), 302 r/w 120(B) of IPC, in Crime No.296 of 2014 on the file of the respondent and hence, seek bail.

2.The case of the prosecution is that on 18.05.2014, the deceased is said to have attacked A2 and A4, for which a case has been registered against the deceased. Due to which, on 16.06.2014, the accused have attacked the deceased with lethal weapons and caused his death.

3.The learned counsel appearing for the petitioners submitted that the petitioners are innocent persons and they have not committed any offence as alleged by the prosecution. He further submitted that the petitioners have been incarceration, since 19.06.2014 and in this case, investigation is over.

4.It is further submitted by the learned counsel appearing for the petitioners that the co-accused were granted bail in Crl.O.P(MD) Nos.15365, 14241 and 16065 of 2014.

5.The learned Government Advocate (Criminal side) submitted that the respondent have almost completed the investigation and they have to file the charge sheet.

6.Considering the facts and circumstances of the case and the co-accused were granted bail, this court is inclined to enlarge the petitioners on bail with certain conditions.

7.Accordingly, the petitioners are ordered to be released on bail, on each of them executing a personal bond for a sum of Rs.10,000/(Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Boothapandy, Kanyakumari District and on further condition that the petitioners shall appear before the respondent police daily at 10.00 a.m. until further orders.
