submit that the petitioners were convicted for the offence under Section 138 of the Negotiable Instruments Act and they were sentenced to undergo one year rigorous imprisonment and the petitioners are directed to pay compensation of Rs.4,50,000/-, 6,30,000/-, 10,00,000/- and 10,00,000/- respectively to the 1st respondent/ indefault to undergo three months rigorous imprisonment each by the judgment dated 06.04.2013 in C.C.Nos.92 and 93 of 2012, 219 and 220 of 2012 respectively on the file of the Judicial Magistrate, Fast Track Court (Magisterial Level), Kovilpatti. Against the said judgments, the petitioners preferred appeals in C.A.Nos.34, 35, 36 and 37 on the file of the learned Principal Sessions Judge, Thoothukudi. In that, substantive sentence has been suspended. At that time, several conditions have been imposed. One of the condition is that he is directed to deposit 1/4th of the cheque amount. Against which, the petitioners have preferred these petitions to modify the order. To substantiate his argument, he has relied on the order of this Court dated 13.12.2012 made in Crl.O.P. (MD) Nos.18362 to 18365 of 2012.
