ORDER : The Court Made the following order :-

The petitioner, who was arrested on 24.11.2012 for offences punishable under Sections 341 and 302 of I.P.C., r/w. 3(2)(v) of SC/ST Act, in Crime No.484 of 2012 on the file of the respondent police, seek bail.

2.The case of the prosecution is that as the deceased questioned the illicit relationship of his wife de-facto complainant with A1, A1 attacked the deceased caused fatal injury to him. A2 and A3 held the deceased, A4 and A5 were the co conspirators.

3.The learned counsel for the petitioner submits that though the de-facto complainant was a witness to the occurrence. He would further submit that the petitioner surrendered and he is in judicial custody for a period of 59 days and he has nothing to do with the alleged occurrence. He further submit that the co-accused had already been released on bail by this Court on 03.01.2013.

5.On consideration of the facts and circumstances of the case and the submissions made, this Court is inclined to grant bail to the petitioner.

6.Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.10,000/-(Rupees ten thousand only) with two sureties for the like sum to the satisfaction of the learned I Additional District and Sessions Judge (PCR), Thanjavur District and on further condition that the petitioner shall report before the respondent police daily at 10.30 a.m until further orders.
