PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C.

ORDER : The Court Made the following order :-

The petitioner prays for the grant of anticipatory bail under Section 438 of Cr.P.C. for offences punishable under Sections 120(b), 406, 467, 471, 420, 294(b) and 506(i) IPC, in Crime No.139/2013, on the file of the respondent police.

The case of the prosecution is that the petitioner and others have created forgery documents and cheated the de-facto complainant. There are totally four accused in this case and the petitioner is A.2.

Learned counsel for the petitioner submits that the petitioner is an innocent and he is nothing to do with the alleged offence.

Heard the Government Advocate (Crl. Side) for the respondent on the submissions made by the learned counsel for the petitioner.

Considering the issue that the petitioner is an attestor to a sale agreement wrongly entered into, this Court is of the view that the petitioner can be granted the relief prayed for and accordingly;

¶18

(a) In the event of arrest by or on appearance before the respondent police;

¶19

(b) In the event of appearance before the learned Judicial Magistrate No.II, Madurai; within 15 days from the date of receipt of copy of the order, order,

(i) The petitioner shall be enlarged on bail on his executing a bond for Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for the https://hcservices.ecourts.gov.in/hcservices/ like sum to their satisfaction;
