PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C.

ORDER : The Court Made the following order :-

The petitioner/accused No.3 in Crime No.22 of 2013 on the file of the respondent police has by apprehending arrest for the alleged offences punishable under Sections 341, 294(b) and 506(ii) of IPC, r/w Sections 4 and 5 of Explosive Substance Act, 1908, approached this Court for an order for his release on anticipatory bail under Section 438 of the Code of Criminal Procedure.

2.Heard the submissions made by the learned counsel appearing for the petitioner and by the learned Government Advocate (Criminal side) appearing for the State.

3.Considering the nature of the offences, nature of the allegations raised against the petitioner, nature and extent of the participation of the petitioner and the stage of the investigation, this Court is of the view that custodial interrogation of the petitioner is not necessary and it is a fit case in which the petitioner can be released on anticipatory bail subject to certain conditions.

4.In the result, this petition is allowed and it is hereby directed that the petitioner shall be released on bail in the event of his arrest or on his surrender before the Court concerned within fifteen days from the date of receipt of a copy of this order, subject to the following conditions:

(i) The petitioner shall execute a bond for a sum of Rs.10,000/https://hcservices.ecourts.gov.in/hcservices/ (Rupees ten thousand only) with two sureties each for a like sum to the satisfaction of the Judicial Magistrate No.II, Virudhunagar;

(ii) The petitioner shall appear before the respondent-police daily at 10.30 A.M until further orders; and

(iii)The petitioners shall follow Section 438 Cr.P.C. Scrupulously.
