PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C.

ORDER : The Court Made the following order :-

The petitioner apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 406, 409, 420 of I.P.C r/w 16 A of Tamil Nadu Pan Brokers Act. in Crime Number 10 of 2013 on the file of the respondent police and hence, seek anticipatory bail.

2 . The Court heard the submissions made by the learned counsel appearing for the petitioner and the learned Government Advocate (Criminal side) appearing for the respondent State.

The learned counsel appearing for the petitioner would submit that the petitioner has nothing to do with the alleged offence as stated in the complaint. He would further submit that most of the jewels belonging to the borrower of the petitioner has been returned.

4 . The learned Government Advocate (Crl. Side) would submit that investigation is going on. Hence, she objects for grant of anticipatory bail.

5 . Considering the facts and circumstances of the case and the submission that pursuant to the functions of the committee appointed by this Court, most of the jewels belonging to the borrower of the petitioner has been returned, this Court is inclined to grant anticipatory bail to the petitioner.

Accordingly, the petitioner is ordered to be released on bail, in the event of his arrest or on his appearance before the learned Judicial https://hcservices.ecourts.gov.in/hcservices/ Magistrate concerned and on executing a bond for a sum of Rs.10,000/(Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, No.IV, Madurai, and on

further condition that the petitioner shall appear before the respondent police as and when required for the purpose of interrogation.

7 . The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy is made ready, failing which, the petition for anticipatory bail stands dismissed.
