The petitioner, who was the Joint Secretary of the Temple Advisory Committee (Upadesaka Samithi) of Thiruvarppu Sri Krishna Swamy Temple, which is a temple under the management of the Travancore Devaswom Board, has filed this writ petition under Article 226 of the Constitution of India, seeking a writ of certiorari to quash Ext.P5 order dated 15.06.2023 of the 3rd respondent Commissioner, Travancore Devaswom Board, whereby the Temple Advisory Committee stands dissolved, for the reason stated therein. The petitioner has also sought for a writ of mandamus commanding the 3rd respondent Commissioner and the 4th respondent Assistant Devaswom Commissioner to reinstate the previous Temple Advisory Committee (Upadesaka Samithi) to complete its remaining tenure and the remaining ‘Pariharapooja’ and such other related activities, thereby fulfilling the promise made by the said committee to the deity, during ‘Devaprasnam’.

Temple, in which the petitioner was the Joint Secretary, for displaying in the temple premises ‘QR code link’ to its bank account, which contained the name ‘e-hundi’, leading to certain UPI transactions. The President and Secretary of the Temple Advisory Committee were issued with show cause notice, to which the Secretary submitted an explanation dated 20.05.2023. The 3rd respondent Devaswom Commissioner called for a report dated 29.05.2023 of the 4th respondent Assistant Devaswom Commissioner. Thereafter, the 3rd respondent issued Ext.P5 order dated 15.06.2023, whereby the Temple Advisory Committee stands dissolved for the reasons stated therein.

whereby the Temple Advisory Committee of Thiruvarppu Sri Krishna Swamy Temple stands dissolved, for displaying in the temple premises ‘QR code link’ to its bank account, leading to certain UPI transactions. The reasoning of the 3rd respondent Devaswom Commissioner in the last paragraph of Ext.P5 order reads thus;

The learned counsel for the petitioner would submit that
the display of ‘QR code link’ to the bank account of the Temple Advisory Committee of Thiruvarppu Sri Krishna Swamy Temple, in the temple premises, leading to certain UPI transactions, was on account of a mistake committed by the Branch Manager, State Bank of India, Thiruvarppu Branch, as evident from Ext.P4 communication dated 19.05.2023 of the Branch Manager, addressed to the 4th respondent Assistant Devaswom Commissioner. ‘Pariharakreeyas’, the 4th respondent Assistant Devaswom
Commissioner has authorised the Temple Advisory Committee to collect a total sum of Rs.2,25,000/-, against sealed coupons. Therefore, any money collected in the bank account of the Temple Advisory Committee through UPI transactions, on account of the display of ‘QR code link’ in the temple premises, can be adjusted against those sealed coupons. As such, the collection of money from the devotees through UPI transactions is no serious irregularity. The Temple Advisory Committee has to complete ‘Pariharakreeyas’, in terms of the ‘Devaprasnam’ conducted in March 2023, for which its reinstatement is highly essential.

festival of the temple is scheduled to commence on 14.04.2024, the 4th respondent Assistant Devaswom Commissioner has taken steps for convening the General Body of the devotees in the ‘registered mandalam’. For that purpose, a notification has already been issued, inviting applications for new membership.

Temple Advisory Committee is to formulate schemes for the betterment and development of the Temple, submit the same before the Board and execute it with the approval of the Board. The Advisory Committee shall collect donations from the devotees for the smooth functioning of the temple activities and festivals only with the permission of the Department.

“3. അുംഗരവും
രാടെ 3.1. ്ദ ഷ്ത്രാചാ ്ങ ളില ും വിത്ഗഹാ ാധനയില ും വിശ്ാസമ ്ള സൂചി്ᩔ ി്ക ്ര വിഭാഗ്ങ ളിൽട്ᩔ്ട ത്പായപൂർ്ᩈ ിയായ ഏടരാ ഹി്മ വിന ും അുംഗരവ്ᩈ ിന് അർഹര ഉ്ി ായി ി്ക ്ര രാണ്. law laid down by this Court in Sunil Kumar C. [2022 (4) KHC
663] , the collection of funds by the Temple Advisory Committee of a temple under the management of the Travancore Devaswom Board, in connection with any festival or ceremonies in the temple, or otherwise, by placing Kanikka Vanchi or Hundis or collection of funds without sealed coupons issued by the Assistant Commissioner, will amount to a financial irregularity by the Temple Advisory Committee. In view of the provisions contained in Clause (18) of the Rules (bye-laws), which provides for sufficient safeguards to prevent illegal collection of funds by the Temple Advisory Committee, an Advisory Committee cannot display QR Code link of its bank account in the temple premises and collect money from the devotees. As per Clause (9.1), the President of the Temple Advisory Committee has to supervise the collection of funds at the initiative of the Advisory Committee and he has to ensure that the functioning of the Committee is in accordance with the directions issued by the Travancore Devaswom Board. As per Clause (9.3), the Secretary of the Advisory Committee has to get the approval of the Department for collection of funds, who has to cause the accounts relating to collection of funds. In the instant case, the procedure adopted by the Temple Advisory Committee, as discernible from Ext.P5 order dated 15.06.2023, while collecting money from the devotees

W.P(C)No.1972 of 2024 through QR link to its account which contained the name ‘e-hundi’, is in violation of the provisions under the aforesaid clauses of the Rules (bye-laws) and in such circumstances, the decision taken in Ext.P5 cannot be said to be either arbitrary or illegal, warranting an interference in exercise of the extra ordinary jurisdiction of this Court under Article 226 of the Constitution of India.
In the result, this writ petition fails and the same is accordingly, dismissed, subject to the directions contained hereinbefore.
