The petitioner is the tenant in R.C.P.No.09 of 2022 of the Rent Control Court, Kollam against whom the respondent-landlord instituted proceedings for his eviction under Section 11(2)(b) and 11(3) of the Kerala Buildings (Lease and Rent Control) Act, 1965 (for short ‘the Act’). During the pendency of the above proceedings, the Rent Control Court, on an application filed by the respondent under Section 12 of the Act, passed order dated 26.07.2023 stopping further proceedings and directing the petitioner to put the respondent in possession of plaint schedule building, due to the failure of the petitioner to make payment of the admitted arrears of rent as directed in the order dated 16.06.2023. The petitioner thereupon filed appeal against the above order before the Rent Control Appellate Authority, Kollam as R.C.A.No.07 of 2023. In the above appeal, the petitioner sought a stay of further proceedings in E.P.No.103 of 2023, instituted by the respondent before the Principal Munsiff’s Court, Kollam, which was declined by the Appellate Authority by virtue of the order dated 14.12.2023 in I.A.No.01 of 2023 in the said Rent Control Appeal.
