O R D E R
Fresh Vakalath is filed for the Additional 2nd petitioner.
Heard the learned counsel for the petitioner and the learned Public Prosecutor.
The trial was held on a charge of the offence punishable under Section 420 of the Indian Penal Code, 1860. The trial court after appreciating the evidence, major portion of which is the oral evidence, found that the prosecution failed to prove commission of the offence beyond reasonable doubt. Since the findings are based, essentially, on the appreciation of oral evidence, I am of the view of that there exists sufficient reason to grant leave to appeal against the judgment of acquittal.
Hence this petition is allowed.
