A surprise inspection was conducted in the premises on 8-03-2009 and observed that an ATM counter was functioning near the main entrance gate with access to the ATM for the pubic. Power supply to the ATM was provided from the consumers premises by installing a sub meter on the back wall of the ATM counter. As the ATM counter was functioning as a separate entity with its name board with power supply extended from the consumers premises and by doing so violated the agreement conditions. Total connected load recorded as per site mahazar at the time of inspection was 263 KW Hence provisional penal bill was issued as per the inspection report of APTS and the direction of the Special officer (Revenue) for unauthorized additional load as well as unauthorized extension of load amounting to Rs.19,36,637/- Being aggrieved by this, the consumer filed petition directly to the Hon'ble CGFF without availing remedies under section 126 & 127 of the Electricity Act. The Hon'ble CGRF disposed the petition of the petitioner directing them to fie objection under section 126 of the Electricity Act 2003, since the impugned bill amounting to Rs.19,36,637/- was issued under section 126 of the Act The Hon'ble Ombudsman also disposed the petition of the petitioner with remarks the unauthorized additional load is coming under the sec126 of electricity Act, which is as per the clarification made by the Regulatory Commission and instructed KSE Board to regurlarise the Additional Load and revise the
