JUDGMENT

This writ petition is filed by the petitioner seeking the following relief:-

“i) To issue a writ of mandamus or such other writ directing the respondent to issue LOP to the petitioner for starting/enhancement of seats for in Exts.P1 to P5, within time frame set by this Hon’ble Court, at any rate within a period of 1 month, so as to enable intake of students for the academic year 202223”

2. Apparently, the petitioner is a Paramedical

College currently offering various courses including in Operation Theatre and Anasthesia Technology. The petitioner has presently submitted Exts.P1 to P3 applications seeking permission for starting new courses and Exts.P4 and P5 applications for enhancing the seats in existing courses, which are pending consideration before the Government. The grievance highlighted by the petitioner is that, the applications were submitted during June 2022, however, no action is initiated by the Government, which may preclude the petitioner from

starting the course from the next academic year.

On instructions, learned Government Pleader submitted that a preliminary inspection was conducted, however, the inspection is not finalised and the writ petition can be disposed of with appropriate directions and the Government will do the necessary in order to consider the application submitted by the petitioner.

Having heard learned counsel for the petitioner Sri.Vinod Bhat and the learned Senior Government Pleader Smt.Deepa N., and perusing the pleadings and materials on record, this writ petition is disposed of directing the Government to consider Exts.P1 to P3 and P4 and P5 applications submitted by the petitioner for new courses and for enhancement of seats at the earliest and at any rate, within one month from the date of receipt of a copy of this judgment. I make it clear that, if there are any defects to the applications, the same shall be notified to the petitioner within ten days from the date of receipt of a copy of this judgment. It is also made clear that, if the

participation and presence of the petitioner is required in order to finalise the applications, the same shall also be sought for sufficiently earlier.
