It is most respectfully submitted that in Ground C of the OP (CAT), the petitioner raised a ground that the Internal Complaints Committee (ICC) constituted in Delhi, does not have jurisdiction to deal with the complaints against the Original Petitioner, in view of the proviso to Sec.4 of the POSH Act. It is most respectfully submitted that, subsequently by communication dated 09.06.2023 the Director Administration, Field Operations Division (FOD), National Statistical Office, Ministry of Statistics and Programme Implementation, Government of India, intimated to all Zonal Heads, Regional Heads and NSO, FOD that, with the approval of the Secretary, Ministry of Statistics and Programme Implementation, a decision has been taken to constitute ICC under the provisions of the Sexual Harassment of women at Workplace (Prevention, Prohibition and Redressal Act, 2013 (POSH Act) for redressal of complaints regarding sexual harassment of women at workplace, on zonal and regional level. A true copy of the letter dated 09.06.2023 issued by Director (Admin/O&M) is produced herewith and marked as Annexure R1(a). Accordingly all the zonal heads and regional heads are requested to constitute a committee immediately in line with the provisions contained in the Act, and convey the Constitution of the same to headquarters within a week. Further, as per the Office Memorandum dated 15.06.2023 issued by the Deputy Director (HO) Regional Offices, Kerala (South) of National Statistical Office. Internal Complaints Committee under the Act has been constituted for Regional Office, Trivandrum. A true copy of the letter dated 15.06.2023 issued by the Deputy Director & HO, Regional Office, Kerala (South) is produced herewith and marked as Annexure R1(b) .
