This is an application for anticipatory bail.

The petitioner is the accused in crime No.210/2023 of

Kaliyar Police Station which was registered for the offences punishable under Sections 308, 326, 324 and 294(b) of the Indian Penal Code.

The prosecution case is that, on 16.04.2023 at 1.30 p.m., the petitioner assaulted the defacto complainant by hitting him with a beer bottle on his head thereby causing injuries to him. The crime was registered in such circumstances and as the petitioner apprehends arrest in connection with the investigation of the said case, this application for anticipatory bail is submitted.

Heard Sri. M.B. Soori, the learned counsel appearing for the petitioner and Smt. Seetha S., the learned Public Prosecutor for the State.

Today, when the matter came up for consideration the learned Public Prosecutor upon instructions submitted that, the investigation in this case is already completed and a final report has been submitted before the Judicial First Class Magistrate’s Court, Thodupuzha on 20.05.2023 and now the matter is pending as C.P. No.82/2023. Since the final report is already submitted, the custodial interrogation of the petitioner is not at all necessary.

In such circumstances, this application is disposed of, directing that the petitioner shall surrender before the jurisdictional court within a period of three weeks from today. Upon such surrender, the petitioner shall be released on bail on executing a bond of `1 lakh with two solvent sureties each for the likesum, to the satisfaction of the jurisdictional court. He shall cooperate with the trial and shall not get involve in any other crimes of similar nature.
