17.11.2022, THE COURT ON THE SAME DAY DELIVERED THE FOLLOWING:

JUDGMENT

Amidst the various assertions, averments and allegations

made and urged in this Writ Petition, when this matter was

¶19

called today, the learned counsel for the petitioner – Sri.N.Sasidharan Unnithan, confined his plea that Ext.P 11 representation be directed to be taken up and disposed of by the competent Authority of the 1^st respondent, within a time frame to be fixed by this Court.

¶20

– In response, Sri.Deepu Thankan learned Standing Counsel for the KSRTC, submitted that if the petitioner only requires Ext.P11 representation to be taken up and disposed of in terms of law, there does not appear to be any legal impediment

in doing so; but prayed that this Court may not make any affirmative declarations on the entitlement of the petitioner to

any relief and leave it to the competent Authority to take a final decision as per law.

¶23

Resultantly, I order this Writ Petition and direct the competent Authority of the 1 st respondent – KSRTC, to take up

Ext.P11 representation of the petitioner and dispose it of, after

affording him an opportunity of being heard; thus culminating in

¶28

an appropriate order and necessary action thereon, as

¶29

expeditiously as is possible, but not later than one month from the date of receipt of a copy of this judgment.

I make it clear that, am fixing the time short on the request of the petitioner that he is suffering from a debilitating

disease.
