is stated that, therefore, there is no established vacancy to accommodate the petitioner herein. It is further stated that, though in terms of the Government Order dated 22.11.2017, and in tune with the Staff Fixation Order, two divisions were sanctioned, in so far as the Physical Science is concerned, due to the fact that the excess HSA (Maths) teachers are accommodated in the dearth vacancy of High School Assistant (Physical Science) and HSA (English), the petitioner cannot be accommodated. It is stated that the Manager had submitted the appointment proposal of the petitioner as HSA (Physical Science) only with effect from 01.06.2018. It is further stated that pursuant to the orders issued by this Court, the 4th respondent has approved the appointment of the petitioner as HSA (Physical Science) with effect from 01.06.2018. It is further stated that as on 14.04.2016, nine divisions were sanctioned as per the Staff Fixation Order, and there were 9 High School Assistants working in the School hence there was no vacancy to accommodate the petitioner. It is also stated that a revision petition filed by the petitioner for approval with effect from 14.07.2016 was still pending before the DGE, and no orders have been passed.
