JUDGMENT

This case has a checkered history whereby the petitioners 27

in number, workers working with the Kottayam Textiles at an earlier point of time, had objected to work during night shift, which resulted into an interim order and filing of Writ Appeal.

The matter was disposed by taking aid of the provisions of Section 66(1)(b) of the Factories Act. Various High Courts across the country have held the provisions aforementioned to be unconstitutional, but as far as the challenge in Kerala is concerned, it has been upheld. With the result, the management transferred the workers to the other Spinning and Textile Mills at Malabar. It is the said orders which are under challenge. This Court at the initial stage admitted the Writ Petition by staying the aforementioned relieving order. The respondents management went in appeal, the matter has been remanded back. In these circumstances, the Writ Petition is pending consideration.

Learned counsel appearing on behalf of the petitioners submitted that since the petitioners are women, they cannot be compelled to do work during night shift and they do not want to put the management on ransom except having a genuine reason and thus prays to the Court to issue appropriate direction for setting

aside the order by looking into the prayer for working in the day shifts.

On the other hand, learned Senior Counsel for the respondents submitted that the Company has various mills which had been earlier running into losses and it was found that after having run under three shifts, the Company has started making profit. Out of the 27 petitioners, 8 and 24 have retired, petitioner No.2 has resigned, 18 to 21 have been terminated, petitioners 4, 10, 12, 16 and 23 have given consent to do work at night. Only 15 petitioners are left who were aggrieved of the aforementioned order. The order do not suffer from any malice or be considered to be vindictive as the relieving order is being preceded by a reasoned order dated 03.12.2021.

I have heard the counsel for the parties and appraised the paper book.

The Kottayam Textiles, a unit of Kerala State Textile Corporation Ltd. has stopped the production from 3^rd January 2020 onwards due to the erosion of working capital and thereby due to the shortage of raw materials. The KSEB has disconnected the supply on 7^th February 2020 due to the huge arrears of electricity bills and lay off was declared in the mill. During the last operating period of the mill, the machine utilisation was 27%. As per the norms in textile industry the required machine utilisation was 95%+. The maximum machine utlisation and thereby maximum production can be achieved only if the mill works in three shifts in full strength. All other mills of Textile Corporation are functioning in three shifts. The other units which are previously running in loss are now running in working profit. The total loss of Kottayam Textiles up to 2018-20 is Rs.1633 lakhs (provisional) and the loss in the financial year just before lay off, is Rs.822 lakhs (provisional). For the existence of the mill, it is highly necessary to function the mill in three shifts in full strength. 54% of the workers are women workers and with the full co-operation of the women workers, the mill can be functioned in three shifts. But 24 women workers are still not ready to work at night 10 p.m. to 6 a.m. They filed case before the Hon'ble High Court of Kerala and obtained stay order against employing them at night between 10 p.m. to 6 a.m. So it is not possible to engage them in the night shifts.

In the above circumstances, the management is compelled to make some arrangements for the existence of the mill. The co-operation from all the workers are required for the benefit of the workers and the mill.

The Kottayam Textiles is re-opened on 1^st November 2021 on the basis of the decision taken in the meeting convened by the Government with the different trade union representative and officers to reopen the mill on 15^th November, 2021. In view of the steps to engage all the workers in three shifts after obtaining consent from the workers, one more chance was given to the worker on 4.11.2021 to give their consent letters. 24 workers are still remains to give consent letters.

It is not possible to engage all the 24 women workers, who have not given consent letters, exclusively in the first two shifts alone. Apart from this, if the 24 workers were completely exempted from night shift, most of the other women workers are not ready to work in the night shift and they have informed accordingly. So it is constrained to adopt other arrangements to employ the women workers who are not willing to work in the night shift and to give them day shift alone, in accordance with their convenience. So that demand of the said workers can be fulfilled and

at the same time the mill can be functioned normally. By considering the interest of the workers and the existence of the mill, and for your convenience to work in two shifts alone, it is informing that the following arrangements are made in your work.

1. You are transferred to Malabar Spinning & Weaving mills, Thiruvannur Nada P.O., Kozhikode 673029 from 03.12.2021.

2. You will get the present salary and other benefits, while working there.

3. You are entitled for transfer Travelling Allowance (TA) and joining time.

4. The working hours at there will be 7.30 a.m. to 2.30 p.m.

5. The mill will provide accommodation at the working place.

6. You will be relieved from Kottayam Textiles and you have to join there before 10.12.2021.

By looking at Ext.P8 one can infer that the order is

objective, but if read conjunctively, it can be found out that the

order of transfer is backed by genuine reasons as until and unless it is not run to its full capacity by undertaking three shifts, it cannot achieve the break even point. It is in that background, the transfer orders have been passed. The said orders cannot be said to be order of exploitation or vindictive particularly when a number of petitioners have given consent. Workers cannot dictate their own terms while undertaking the task of their vocation. Management accepted to the request in complying with the provisions of Section 66(1)(b) of the Factories Act, keeping in fact their gender. I do not find any opaqueness, illegality or arbitrariness much less discrimination in the orders under challenge warranting judicial review under Article 226 of the Constitution of India.

The Writ Petition sans merit, accordingly dismissed.
