The above Regular Second Appeal has been filed against the judgment and decree in A.S. No.29/2008 on the files of Subordinate Judge’s Court, Muvattupuzha which arise out of judgment and decree in O.S. No.301/2004 on the files of Munsiff Court, Muvattupuzha.

When the matter came up before this Court, the parties are refered for mediation, Mediation Centre, High Court of Kerala, Ernakulam and the matter has been settled between the appellant as well as the 2^nd respondent in the RSA, who has been styled as the 1^st respondent in the mediation agreement. Before the Munsiff’s Court as well as the 1^st Appellate Court the original 1^st defendant/1^st respondent Dr. Poulose Abraham remained ex-parte. The real dispute is between the appellant as well as the 2^nd respondent, who has been signed in the mediation agreement as the 1^st respondent.

executed between the parties, terms of agreement are seem to be legal and proper. Hence, memorandum of agreement executed between the parties is hereby recorded. Hence, RSA is disposed of in terms with the mediation agreement. The mediation agreement will form part of the decree.
