The petitioner is the defacto complainant in crime No.387/2022 of Pettah Polce Station. The aforesaid crime was registered against the accused persons for the offences punishable under Sections 420, 468 and 471 of the Indian Penal Code.

The grievance of the petitioner is that, no proper investigation is being conducted by the Investigation Officer. In such circumstances, the petitioner submitted Crl.M.P. No.1002/2022 in the aforesaid crime before the Additional Chief Judicial Magistrate’s Court, Thiruvananthapuram, seeking appropriate orders in this regard. One of the prayers sought in this original petition is to direct the learned Magistrate to consider the said application and dispose of the same within a time limit.

Considering the facts and circumstances, the aforesaid application is pending consideration, I am of the view that, this original petition can be disposed of directing the learned

Magistrate to consider the same within a time frame. In the facts and circumstances of the case, I deem it appropriate to fix the time as one month from the date of production of a copy of this judgment. Accordingly, it is ordered that the decision in Crl.M.P. No.1002/2002 in crime No.387/2022 of Pettah Police Station shall be taken by the learned Magistrate within the period mentioned above after hearing the parties concerned.
