The petitioner is claimed to be the owner of a Maruti Wagon R car, bearing registration number No.KL 25 L 8023. According to the petitioner he purchased the vehicle from the 2nd respondent for which one Vineesh was the mediator. It is also claimed that he paid a sale consideration of Rs.3 lakhs and the same was handed over to him along with the vehicular documents. However, the vehicle is even now stands registered in the name of the 2nd respondent. In the meanwhile, on the basis of the complaint submitted by the 2nd respondent, crime No.1142/2021 was registered by the Punalur Police and as part of the investigation of the same the vehicle was seized from the possession of the petitioner herein. Later, the petitioner submitted an application Crl.M.P. No.2547/2021, seeking custody of the vehicle and the 2nd respondent submitted Crl.M.P. No.2700/2021. The learned Magistrate as per Annexure A5 order, dismissed Crl.M.P. No.2547/2021 submitted by the petitioner and allowed Crl.M.P. No.2700/2021. This Crl.M.C. is filed challenging Annexure A5 order to the extent it permitted the release of the vehicle in favour of the 2nd respondent.
