Since common issues are raised, these appeals and revision petitions are heard together and are being disposed of by this common judgment/order.

The marriage between the 1^st appellant-husband and the respondent-wife in Mat.Appeal No.180 of 2020 was solemnized on 19.04.2015. The respondent-wife filed O.P.No.99 of 2017 before the Family Court, Kottayam at Ettumanoor, seeking a decree for return of money and gold ornaments. In that original petition, the husband filed a counter claim. The Family Court tried that matter along with connected cases. By a common judgment dated 23.11.2019, the Family Court decreed O.P.No.99 of 2017 filed by the respondent-wife and the counter claim filed by the 1^st respondent-husband in part. Challenging the said judgment and decree of the Family Court, to the extent of decreeing O.P.No.99 of 2017 in part, the appellant-husband and his parents have filed Mat.Appeal No.180 of 2020. No.8 of 2020 is filed by the wife challenging the common judgment dated 23.11.2019 of the Family Court, whereby O.P.No.99 of 2017 filed by her was allowed only in part. Mat.Appeal No.9 of 2020 is filed by the wife challenging the common judgment dated 23.11.2019 in O.P.(Divorce) No.105 of 2017, filed by the husband. By the impugned judgment, the Family Court granted a decree of divorce on the ground of cruelty. R.P.(FC) No.112 of 2022 and R.P.(FC) No.124 of 2022 were filed by the wife and husband respectively challenging the order dated 11.11.2021 in M.C.No.117 of 2006 of the Family Court.

These cases were admitted to file and the respondent entered appearance through learned counsel.

On 12.08.2022, when these matters came up for consideration, this Court directed both the parties to appear in Court on 26.08.2022 at 10.15 a.m. On 26.08.2022, both parties were referred for mediation before the Ernakulam Mediation Centre, in the premises of this Court.

The parties have now settled the entire dispute in

mediation. The mediation settlement agreement dated 14.10.2022 is placed on record, along with the report of the Mediator dated 14.10.2022.

Today, when these matters are taken up for consideration, the learned counsel on either side would submit that both the parties have settled the entire dispute between them in mediation and in terms of the settlement, various claims of the wife have already been satisfied. Thereafter, in terms of the compromise, the husband and wife have filed a joint petition before the Family Court, Kottayam at Ettumanoor, as O.P.No.1508 of 2022, under Section 10A of the Indian Divorce Act, 1869, for a decree of divorce on mutual consent, which is now pending consideration of that court.

Having considered the submissions made by the learned counsel on both sides and taking note of the filing of a joint petition by both parties under Section 10A of the Indian Divorce Act, seeking a decree of divorce by mutual consent, which is now pending before that court as O.P.No.1508 of
