This is an application for anticipatory bail.

The petitioner is the accused in Crime No.96/2022 of

Ayiroor Police Station, alleging commission of offences punishable under Sections 294(b), 323, 324, 341 and 308 of the Indian Penal Code.

The case of the petitioner is that it is the defacto complainant who has attacked the petitioner and he sustained injuries as is evident from Annexures-B & C and that in connection with the said alleged incident a crime was registered as Crime No.136/2022.

Learned Public Prosecutor seriously opposed the bail application mainly contending that the the defacto complainant sustained serious injuries. It is seen that the petitioner has also undergone treatment as inpatient as it is evident from Annexure-B wound certificate and Annexure-C discharge summary. The further case of the petitioner is that there is a

delay in lodging the FIR. The incident happened on 27.01.2022 and the complaint was filed only on 02.02.2022 and the delay is not explained. It is further submitted that the petitioner has no other criminal antecedents.

Having regard to the facts and circumstances of the case, considering the nature of the allegation, I am inclined to grant anticipatory bail to the petitioner. In the result, the bail application is allowed. Petitioner shall surrender before the investigation officer on 1 0.08.2022 at 11.00 AM for interrogation and also make himself available for interrogation on any other day/days as directed by the investigating officer. In the event of arrest of the petitioner in Crime No.96/2022 of Ayiroor Police Station, the petitioner shall be produced before the jurisdictional Magistrate and shall be released on bail on the following conditions:

(i) The petitioner shall execute a bond for a

sum of Rs.50,000/- (Rupees fifty thousand only) with two solvent sureties each for the likesum to the satisfaction of the Jurisdictional Court,

(ii) The petitioner shall appear before the investigating officer in Crime No.96/2022 of Ayiroor Police Station, as and when called for,

(iii) The petitioner shall not attempt to influence the defacto complainant or interfere with the investigation or to influence or intimidate any witness in Crime No.96/2022 of Ayiroor Police Station,

(iv) The petitioner shall not enter the limits of Ayiroor Police Station for a period of one month, where the defacto complainant is residing except for the purpose of complying with any court proceedings or complying with any condition as above,

(v) The petitioner shall not involve in any other crime while on bail.

If any of the aforesaid conditions are violated, the investigating officer in Crime No.96/2022 of Ayiroor Police Station, may file an application before the jurisdictional Court, for cancellation of bail.

It is made clear that it is within the power of the police to investigate the matter and if necessary to effect recoveries on the information if any given by the petitioner even when the petitioner is on bail as per the judgment of the Apex Court in Sushila Aggarwal and others v. State (NCT of Delhi) and another (2020 (1) KHC 663).
