Since the issues involved in all the writ petitions are the same, they were posted together and are heard and disposed of by this common judgment.

The petitioner states that he is the owner of a non-residential building in a property having an extent of 1.50 cents comprised in Re. Sy Nos.1-371542 and 1-37-1509 located near Nadakavu East junction on the western side of ManachiraVellimadukunnu road, a portion of National Highway (NH-212). The petitioner is running an automobile spare parts shop in the said building.

The 3^rd respondent issued Ext.P4 notification under Section 4 (1) of the Land Acquisition Act, 1894

(for short 'the Act') in relation to certain properties including the aforesaid property of the petitioner. Ext.P4 notification under Section 4 (1) was published

in the Kerala Gazette on 28.11.2011. Pursuant to that, Ext.P5 declaration under Section 6 (1) of the Act was issued by the 2^nd respondent on 20.04.2013 and the same was published in the Gazette on 24.04.2013.

This writ petition was filed on 15.07.2013 contending inter alia that there is no justification on the part of the 2^nd respondent to invoke the urgency clause under Section 17 of the Act and that the acquisition proceedings are vitiated by malafides. It is also contended that Ext.P5 declaration under Section 6 (1) was published after one year from the date of publication of Section 4 (1) notification and therefore the same is invalid in terms of Clause (ii) of the

proviso to Section 6 of the Act. The prayer in the writ petition is to quash Ext.P3 order issued under Section 17(4), Ext.P4 notification under Section 4(1) and Ext.P5 declaration under Section 6(1).

Respondents 3 and 5 have filed counter affidavits in the writ petition resisting the averments in the writ petition. No interim order was granted in the writ petition.

During the pendency of the writ petition, the petitioner filed I.A No.1 of 2021 to amend the writ petition. In the said interlocutory application, the petitioner states that, though Section 6 (1) declaration was published on 24.04.2013, no award

was made within two years from the date of publication of the declaration and therefore, the acquisition proceedings have lapsed. Accordingly, the petitioner has sought to incorporate a prayer to

declare that the entire proceedings for acquisition of the land in question shown as Serial No.77 in Ext.P5 declaration have lapsed and to interdict the respondents from proceeding further in pursuance of Exts.P3 to P5 in relation to his property. The contention of the petitioner is that, Ext.P5 declaration was published in the official gazette on 24.04.2013 and published i n Mathrubhumi Daily da ted 29.06.2013 and Deshabhimani Daily dated 21.06.2013 and public notice as mandated by Section 6 (2) was made at the office of Tahsildar on 29.06.2013 and at the concerned Village offices on 20.06.2013. According to Sri. Sudhi Vasudevan, the learned Senior Counsel for the petitioner, since no award was passed by the 4^th respondent within a period of two years from the date of publication of Section 6(1) declaration, the entire acquisition

proceedings have lapsed in terms of Section 11A of the Act. It is also submitted by the Senior Counsel that there was no stay of proceedings pursuant to the declaration.

I.A No.1 of 2021 to amend the writ petition

was allowed on 03.11.2021 and the learned Government Pleader was asked to get instructions with regard to the prayer in the amended writ petition.

Today, when the matter came up for further consideration, the learned Government Pleader, on instructions, submits that no award has been passed by the District Collector within the period of two years from the date of publication of the 6(1) declaration.

Section 11A of the Act reads as follows:

“11A.Period within which an award shall be made. - The Collector shall make an award under

section 11 within a period of two years from the date of the publication of the declaration and if no award is made within that period, the entire proceedings for the acquisition of the land shall lapse:

Provided that in a case where the said declaration has been published before the commencement of the Land Acquisition (Amendment) Act, 1984, the award shall be made within a period of two years from such commencement.

Explanation – In computing the period of two years referred to in this section, the period during which any action or proceeding to be taken in pursuance of the said declaration is stayed by an order of a Court shall be excluded.

Since no award has been passed with

respect to the property of the petitioner within a period of two years from the date of publication of declaration under Section 6(1), the acquisition

proceedings have lapsed. It is submitted that since there was no stay of proceedings in pursuance of the declaration under Section 6 (1), the provisions under the Explanation to Section 11A has no application. Accordingly, it is declared that the entire proceedings for acquisition of the land of the petitioner shown as Serial No.77 in Ext.P5 declaration have lapsed.

The learned Government Pleader submits tha t, steps are being taken to issue a ne w notification under Section 11 (1) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. This submission is recorded. The learned Senior Counsel for the petitioner submits that permission may be given to the petitioner to raise objection to the fresh notification with direction to the respondents to consider the same. It is too premature for the

petitioner to make such a prayer at this point of time.

This writ petition is disposed of in the light of the provisions under Section 11 A of the Act. All other contentions raised by the parties in this writ petition are left open.

The learned Senior Counsel for the petitioner submits that, in the light of the judgment in W.P. (C) No.17730/2013, this writ petition has become infructuous. Accordingly, this writ petition is dismissed as infructuous.

The petitioners in this writ petition challenge the acquisition proceedings initiated in respect of their properties pursuant to Ext.P10 notification under Section 4(1) of the Act (Ext.P4 in W.P.(C) No.17730/2013) on various grounds. Sri. S. Ajith, the

learned counsel for the petitioners submits that no award has been passed in respect of the properties of the petitioners within the time stipulated under Section 11A of the Act and that he adopts the argument of the learned senior counsel for the petitioner in W.P. (C) No.17730/2013 and the writ petition may be disposed of in the light of the judgment in W.P. (C) No.17730/2013. Since no award is passed in respect of the properties of the petitioners within the time stipulated under Section 11A of the Act, the acquisition proceedings in respect of their properties pursuant to Ext.P10 have lapsed. With this declaration and leaving open all other contentions raised by the parties, this writ petition is disposed of.
