including conditions as to the maintenance, interviews or communication with others, discipline and punishment of breaches of discipline as the appropriate government may by general or special order specify and to be removed from the place of detention to another place whether within the same State or in another State by order of the appropriate government. Reference has also been made to Section 27(3) and (4) of the Prisons Act, 1894 and it is submitted that unconvicted criminal prisoners shall be kept apart from convicted criminal prisoners and civil prisoners shall be kept apart from criminal prisoners. Referring to Section 31 of the Act it is stated that maintenance of certain prisoners from private sources, a civil prisoner or an unconvicted criminal prisoner shall be permitted to maintain himself and to purchase, or receive from private sources at proper hours, food, clothing, bedding or other necessaries, but subject to examination and to such rules as may be approved by the Inspector General. Thus the petitioners have moved this Court for separating the said hardcore criminal from the detenus under the COFEPOSA Act, and to provide them conveniences that are available to a civil
