Learned Counsel for the petitioner presses for orders on the application seeking interim custody of the minor child. Learned Counsel for
the respondents submits that the original petition, of which transfer is sought, was not pressed before the Family Court and nothing survives for consideration in this transfer petition.
As rightly pointed out, as the original petition was not pressed, relief sought herein has been rendered infructuous. Accordingly, the transfer petition is closed, reserving the petitioner's right to approach the Family Court for appropriate relief.
