Petitioner, accused in crime No.37/2021 of Adimaly

Excise Range is before Court, seeking his release on bail under Section 439 of the Cr.P.C. The crime was registered alleging offence under Sections 58 and 67B of the Abkari Act.

The allegation is that on 14.04.2021 at 8 p.m., the petitioner was found in possession of 150 litres of Indian made foreign liquor; he was arrested along with the contraband and was remanded to judicial custody.

The learned counsel for the petitioner submits that later, on 14.05.2021, he was granted interim bail on the basis of the guidelines issued by the High Power Committee and that he is continuing on interim bail.

The learned Public Prosecutor has testified that he has no criminal antecedents.

The case was registered on 14.04.2021 and the petitioner had been in custody for nearly one month. The investigation has progressed considerably. He has no criminal

antecedents to his credit. Therefore, his further detention is not necessary. In the circumstances, he shall be released on

bail, making the interim order absolute, on the following conditions:-

i) Petitioner shall execute bond for Rs.50,000/(Rupees Fifty Thousand only) with two solvent sureties each for the like sum to the satisfaction of the jurisdictional Court;

ii) He shall not try to contact or influence the witnesses or tamper with evidence;

¶28

iii) He shall not leave the country without leave of the jurisdictional court;

¶29

iv) He shall not involve in any crime during the period on bail;

¶30

v) He shall appear before the Investigating Officer/trial Court as and when required;

¶31

vi) He shall strictly abide the various guidelines issued by the State and Central Governments with respect to keeping of social distancing in the wake of Covid 19 pandemic;

vii) If any of the above conditions are violated by the petitioner, the jurisdictional court will be a liberty to cancel the bail in accordance with law.
