This is an application filed under Section 438 of the Cr.P.C seeking anticipatory bail. The petitioner is the sole accused in Crime No. 96 of 2021 of Pattambi police station which was registered alleging offence punishable under Section 465, 468, 471 and 420 of the I.P.C. The specific allegation is that he had forged building permit using false seal etc.

The learned counsel for the petitioner submits that, on the basis of the order dated 7^th May 2021, he had surrendered before the Investigating Officer and made himself available for interrogation, thereafter recovery was effected and further interrogation is not necessary.

The learned Public Prosecutor submits that the investigation is not over and he may have to interrogated again. Anyhow, the learned counsel submits that he is prepared to cooperate with the investigation.

Sri. Aslam Sanjay, learned counsel appearing for the 2^nd respondent has submitted that, after getting interim bail the petitioner had surrender before the Investigating Officer and necessary documents have been handed over. He has no objection

in granting anticipatory bail to the petitioner.

In the circumstances, the petitioner shall be at liberty to surrender before the Investigating Officer within ten days from today and will make himself available for interrogation; in the event of arrest, he shall be released on bail on executing bond for Rs.50,000/- (Rupees fifty thousand only)with two solvent sureties each for the like sum to the satisfaction of the Investigating Officer; he shall co-operate with the investigation, shall not try to contact or influence the witnesses or tamper with the evidence and shall not involve in any crime during the period on bail.
