In fact, a perusal of Ext.P7 licence in form LE-3 would reveal that it is a licence to possess for sale of explosives of Class 1,2,3,4,5,6 or 7 in a magazine, going by Article 3(b). Licence in Form LE-1 is a licence to manufacture gun powder and fireworks. The very fact LE-3 licence is issued to possess explosives for sale itself would go to show that it cannot be a condition required to be fulfilled by an applicant for public fireworks display. Hence, how can an office bearer of a festival committee or any competent person of the temple concerned who files an application seeking licence for public display of fireworks in connection with a festival in a temple be required to possess an LE-3 licence for possessing fireworks for sale. In such circumstances, the reason assigned for rejecting the application that the applicant did not possess magazine with LE-3 licence is essentially a matter to be looked into by the appellate authority. We may hasten to add that we shall not be understood to have observed that to manufacture fireworks and for their possession and sale, LE-1 and LE-3 licences respectively are not required. True that, any such public fireworks display in connection with a temple festival could be supervised only by a person having experience in manufacturing and conducting public fireworks display, on the strength of requisite licences.
