The dispute arising in these cases relates to appointment of LPSA and a UPSA, in S.N.U.P. School, Thrikkakara. The parties and documents referred to in this judgment are as described in W.P.(C) No.7309/2020 unless otherwise specified.

2. One vacancy arose in the school consequent to the promotion of Smt.Gayathri.K.V. as Headmistress with effect from 01.06.2016. The Manager appointed Smt.Remitha Rajan as LPSA with effect from 01.06.2016 against that vacancy.

Smt.Manya was appointed as UPSA on 24.06.2016 against an additional division vacancy. Both appointments were rejected by the Assistant Educational Officer on the ground that protected teachers should have been appointed in the School against the vacancies. Appeals submitted by the Manager, were also rejected.

3. The Director of Public Instructions

passed an order on 16.08.2018, which is produced as Ext.P7 in W.P.(C) No.7309/2020. DPI found that the vacancy of LPSA was available consequent to the promotion of Smt.Gayathri as Headmistress and that since there is no ban against appointments made in pre-upgraded schools, the said appointment could be approved.

4. As against Ext.P7 order, Smt.Manya submitted Ext P11 Revision Petition before Government seeing that Remitha's appointment would be approved. At that time, appeal filed by the Manager against the orders rejecting approval to the appointment of Manya was pending consideration

before the DPI. On receipt of the Revision Petition of Manya, Government deputed a Super Check Cell Officer to conduct an enquiry into the matter. At that stage Smt.Remitha Rajan approached this Court, in W.P.(C) No.11606/2019, complaining

that orders of approval were not passed in

implementation of Ext.P7 order issued by the DPI. Smt.Manya, who was the 5^th respondent therein, submitted that an appeal was pending against denial of approval to the appointment of Smt.Manya, before the Director of Public Instructions. This Court directed the Government to consider the Revision Petition submitted by Smt.Manya along with the appeal filed by the Manager before the DPI against rejection of approval to her appointment and pass orders after hearing both the teachers as well as the Manager. Government thereafter passed Ext.P18 order.

5. The Manager and Smt.Remitha Rajan has filed W.P.(C) Nos.7309/2020 and 4966/2020, challenging Ext.P18 order. At the same time, Smt.Manya has filed W.P.(C) No.4410/2020, seeking implementation of Ext.P18 order. In Ext.P18, Government found that Smt.Gayathri was originally appointed as UPSA and she was retrenched consequent to division fall and she was deployed

in another School. On repatriation, when a vacancy arose in the School, she was reappointed there in the year 2003 against a vacancy of LPST. Government found that, as and when a vacancy of UPSA arose in the School, the Manager ought to have shifted her to the post of UPSA in accordance with G.O.(Ms) No.178/2002/G.Edn. Dated 28.06.2002; but the Manager did not shift her to her original post of UPSA though vacancies of UPSA arose in the year 2006, 2007 and 2010; the Manager appointed fresh hands as against those vacancies of UPSA. In those circumstances, Government found that on account of promotion of Gayathri as Headmistress, a vacancy arose in the School in the post of UPSA. Government also relied on the report submitted by Super Check Cell Officer. In that report it was stated that on examination of the service records of Smt.Gayathri and other records in the school, the action of the Manager in not shifting the lien of Smt.Gayathri against the

vacancy of UPSA was irregular and that the Manager should have shifted Smt.Gayathri to either of those vacancies of UPSA. It was further found that as per the staff fixation for the year 2016-17, there were 8 divisions in LP Section and hence 8 posts of LPST. At the same time, there were 6 divisions for UPSA and 5 posts of UPST and one post of Headmistress (post of Headmistress is reckoned as a vacancy available to UP Division). Apart from that, one post of UPST was also allowed as against the exemption vacancy of Head teacher. Therefore Government found that Smt.Manya was entitled to be appointed and approved as against the said vacancy, which arose on promotion of Smt.Gayathri.

6. Ext.P18 order would show that hearing was held again on the Revision Petition submitted by the teachers on 01.10.2019 on the basis of the judgment of this Court in which the teachers, their counsel as well as the Manager's

representative were also present.

The learned counsel for the Manager pointed out that Government had not issued any notice with respect to the hearing on the Revision Petition filed by Smt.Manya, against the order passed by the DPI and copy of the Revision Petition was not furnished to the Manager. The notice received by the Manager is produced as Ext.P13 in W.P.(C) No.4966/2020. Ext.P13 notice dated 26.07.2018 produced by the Manager, refers to a representation submitted by Smt.Manya on 09.07.2018; a Revision Petition filed by Smt.Manya on 16.03.2018 before the Government and a letter from Government on 06.07.2018. The notice was issued fixing the date of hearing on 09.08.2018. According to the Manager, there was no reference of the Revision Petition filed by Smt.Manya against the order in favour of Smt.Remitha Rajan in the notice. It is stated that even after the judgment of this Court, the Manager was not

informed about the hearing proposed to be held in respect of Smt.Manya's Revision Petition, though this Court had directed disposal of the same. It is submitted that the Manager was unable to make any submissions in respect of Smt.Remitha Rajan's appointment and approval. The Manager has also stated that in those circumstances, the Manager has preferred a Revision Petition before the Government.

8. Serious contentions are raised by the Manager as well as Smt.Remitha Rajan. Smt.Manya has also produced various orders stating that even the order of appointment, the submission of proposal for approval by the Manager in respect of Smt.Manya as well as Smt.Remitha Rajan, are not submitted correctly and she has also raised allegations as to the manipulations carried out in the proceedings in the office of the AEO.

with respect to the appointments made in the post of UPSA against the vacancies, which arose in 2009, 2010, 2012 etc, were absolutely unsustainable as all this appointments were approved and Smt.Gayathri continued in the post of UPSA with approval all along. It is also their contention that an enquiry by the Super Check Cell Officer was unnecessary. They have also raised a contention to the effect that Smt.Manya did not have any complaint as against the order passed by the DPI till May, 2019, when she submitted the Revision Petition.

10. From the staff fixation orders, it is seen that there were 8 posts of LPSA and 5 posts of UPSA in addition to the Headmistress's post. From the staff fixation proceedings, Ext.P4 in W.P.(C) No.7309/2020, it is seen that there are 8 posts of LPSA and 5 posts of UPSA in addition to the post of Headmistress and one post, on account of exemption for Head teacher. At the relevant time

when the appointments were made, there are only 8 LPSAs including Smt.Remitha Rajan and there were 5 teachers including Smt.Manya. But it is seen that the 5^th post of UPSA was against an additional division vacancy, which can be filled up only by a protected teacher, in view of the provisions contained in Rule 7 of chapter 21 of KER introduced by 2016 Amendment Rules.

11. Therefore, it would not be possible to accommodate both Remitha Rajan and Manya unless the Manager gives an undertaking to appoint a protected teacher against a vacancy of UPSA.

Though the notice of hearing was issued to the Manager and Remitha Rajan, it is seen that the Manager was never informed about the error he committed by not shifting Smt.Manya or the findings arrived at by the Super Check Cell Officer. When Smt.Gayathri was reappointed in 2003 and all further appointments in the vacancies of UPSA, which arose upto 2009, were approved by the

educational officers, the Government ought to have given an opportunity to the Manager to explain his stand on such appointments before taking a decision on the deemed shifting of Smt.Gayathri as UPSA providing for approval of Smt.Manya.

Therefore, I am of the view that the Government has to take a decision after affording an opportunity of hearing to all the parties with respect to the appointments made to the vacancies of UPSA, which arose after the reappointment of Smt.Gayatri and on the report of the Super Check Cell Officer.

Ext.P18 order (G.O(Rt) No.575/2020/G.Edn. dated 31.01.2020) shall stand set aside for the limited purpose of re-hearing. The orders shall be passed within a period of three months from the date of receipt of a copy of the judgment.

Accordingly, the writ petition is disposed of.
