Instant writ petition is filed by the petitioner aggrieved by the lethargy and inaction on the part of the officials of Oushadhi – Kerala, in not adhering to the prescribed standard in making its products and non-utilization of grants received from Ministry of AYUSH (Ayurveda, Yoga and Neuropathy, Unani, Sidha and Homeopathy) under Government of India.

Oushadi, an enterprise under the Government of Kerala, is the largest manufacture of Ayurvedic products and herbal drugs in India. It is established for the specific purpose of ensuring prescribed quality and standard in manufacturing ayurvedic medicines for effective ayurvedic treatment. The public at large in Kerala is largely depending ayurvedic treatment for curing various diseases. Oushadi is also receiving huge fund as grant from Government of India from time to time for utilising the same for the purpose of establishing centre of excellence and modernization and to ensure quality treatment and medicine.

According to the petitioner, it is recently noticed that, the ayurvedic and herbal products from Kerala manufactured by Oushadi is banned in many of the European countries and some of the Asian countries, due to the presence of pesticides, heavy metals, aflatioxine, toxicity extracts etc. A study also shows that there is alarming increase in cases of cancer, kidney and liver

diseases in Kerala as 77% of the household in Kerala are using ayurvedic products for various treatment and other purposes.

According to the petitioner, the ayurvedic products manufactured from Oushadi is distributed to the public without conducting proper test to rule out the presence of pesticides, metals and other toxic substances in its product. Though Oushadi is given financial aid by the Central Government, it has not purchased the machinery GCMS(Gas Chromatography Mass Spectrometric), which is the basic testing machine for testing the presence of pesticides.

Pointing out the above facts, petitioner has submitted Ext.P8 complaint dated 1.9.2020 to respondents 1 to 4, requesting to enquire into the matter, and to take necessary action against the officials of Oushadi. On receipt of the complaint, the Secretary, Ministry of AYUSH, Ayush Bhavan, New Delhi, 2^nd respondent, has forwarded the same to the Principal Secretary (AYUSH), Trivandrum, 5^th respondent, with a copy to the Drugs Controller and Licensing Authority, Government of Kerala, Trivandrum, 6^th respondent, for further action but no action is taken yet. It is in this background, the instant writ petition is filed for the following reliefs:

(i) issue a writ of mandamus or any other writ or order directing the respondents 1 to 6 to initiate appropriate steps against the 7^th respondent by conducting an enquiry on the basis of Ext.P8 complaint filed by the petitioner.

(ii) issue a writ of mandamus or any other writ or order directing the 5^th and 6^th respondents to take appropriate action on the basis of Ext.P9 communication within a time bound manner.

On this day when the matter came up for admission, Mr. P. Abdul Raoof, learned counsel for petitioner, submitted that petitioner would be satisfied, if the State Authority is directed to look into the matter and take appropriate decision on Exhibit-P9 communication dated 26.10.2020 sent by

the Ministry of AYUSH, New Delhi, to the Principal Secretary (AYUSH), Thiruvananthapuram, Kerala, 2^nd respondent.

Heard learned counsel for parties and perused the pleadings and materials on record.

In the light of the above submission, there is no need to delve into the merits of Exhibit-P8 complaint dated 1.9.2020 addressed to respondents 1 to 4. Communication of the Ministry of AYUSH, New Delhi addressed to the Principal Secretary, Thiruvananthapuram, Kerala is reprodcued.
