The petitioner states that he is a timber merchant doing business at Kallayi in Kozhikkode. He contends that by various documents executed by the erstwhile owners, he came into possession of the said property; the documents being Nos.895/2001, 46/2001 and 147/2002 of the Sub Registrar’s Office, Kozhikode. According to him, he has acquired leasehold rights as per the above documents, which is a perpetual lease granted by the crown. It is contended that in the year 2007, notices were issued to the persons having property on the sides of the Kallai River, proposing to evict them on the ground that they are unauthorised occupants. The petitioner challenged the proceedings by filing WP (C) No. 16349/2007 and this Court while ordering to maintain status quo, permitted the survey of the land in dispute. However, by judgment dated 21.07.2007, the writ petition was disposed of holding that the notices issued in 2007 cannot be proceeded with and reserving the liberty of the authorities to proceed for eviction in accordance with law and with notice to the petitioner. Thereafter proceedings under the Land Conservancy Act, 1957 was initiated against the petitioner and others and they were asked to vacate within a period of 10 days.
